1. Acceptance of Terms

By placing an order with Medical Testing Solutions ("we," "us," or "our"), you agree to these Terms of Sale. These terms govern all product purchases and service engagements made through our website, email, phone, or any other ordering method.

2. Ordering and Quotes

All product orders are subject to availability and acceptance by Medical Testing Solutions. Prices quoted are valid for 30 days from the date of the quote unless otherwise specified. We reserve the right to correct pricing errors at any time before shipment.

Quote requests submitted through our website are not binding orders. A binding purchase agreement is formed only upon our written confirmation or upon processing of payment.

3. Pricing and Payment

All prices are quoted in U.S. Dollars (USD) and do not include shipping, handling, or applicable taxes unless explicitly stated.
Payment is due at the time of order unless alternative payment terms have been arranged in writing.
We accept payment via credit card (Visa, Mastercard, American Express), ACH transfer, and wire transfer.
For orders requiring custom fabrication or special-order items, a non-refundable deposit may be required.

4. Shipping and Delivery

Shipping costs and estimated delivery times are detailed in our Shipping Policy, which is incorporated into these Terms by reference.
Standard Ground orders under $500 ship at a flat $15.00 USD; orders of $500.00 USD or more ship free within the contiguous 48 states.
Estimated handling is 1–2 business days for in-stock items and 5–10 business days for made-to-order items; estimated transit is 1–7 business days (Standard Ground) or 3–10 business days (freight/oversized).
Risk of loss and title for products pass to the buyer upon delivery to the shipping carrier (FOB Origin).
We ship to all 50 U.S. states. International and U.S.-territory inquiries: contact us directly.
Customers are responsible for inspecting shipments upon receipt; damage or discrepancies must be reported within 48 hours of delivery.

5. Order Cancellation

Orders may be cancelled without penalty if cancellation is received before the order has shipped. Once an order has shipped, cancellation is subject to our Returns and Refunds Policy, including applicable restocking fees.

Custom or special-order items cannot be cancelled once production has begun.

6. Product Warranty

Products sold by Medical Testing Solutions are covered by the manufacturer's warranty, where applicable. We do not provide additional warranties beyond what the manufacturer offers unless explicitly stated in writing.

Warranty claims must be submitted directly to the manufacturer or coordinated through our customer service team.

7. Service Terms

For medical gas testing, verification, inspection, installation, and training services:

Service quotes are based on the scope of work described at the time of the estimate.
Additional work discovered during service may require a revised quote and customer approval.
Cancellation of scheduled service appointments must be made at least 48 hours in advance to avoid cancellation fees.
All services are performed in accordance with applicable NFPA 99, ASSE, and Joint Commission standards.

8. Limitation of Liability

To the maximum extent permitted by law, Medical Testing Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of our products or services. Our total liability shall not exceed the amount paid by you for the specific product or service giving rise to the claim.

9. Force Majeure

We shall not be liable for any delay or failure to perform our obligations due to causes beyond our reasonable control, including but not limited to natural disasters, pandemics, supply chain disruptions, government actions, or labor disputes.

10. Governing Law

These Terms of Sale shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in the State of Florida.

11. Returns, Refunds, and Exchanges

Eligible returns must be initiated within 30 days of delivery and are subject to a 25% restocking fee on the purchase price.
Items must be unused, unopened, and in original packaging, with a Return Merchandise Authorization (RMA) issued in advance.
The customer is required to cover the cost of all return shipping. Original shipping charges and return shipping are non-refundable.
We do not accept exchanges. To obtain a different item, return the original product (subject to the policy above) and place a new order.
Damaged-on-arrival or mis-shipped items are eligible for a free prepaid return label and full refund or replacement, with no restocking fee.
Custom, special-order, made-to-order, opened, used, installed, modified, or hazardous-materials items are non-returnable.

12. Business Identity and Contact

The seller of record for all transactions on this website is Medical Testing Solutions LLC, a Florida limited-liability company. Our principal place of business and authorized return address are made available to customers prior to and at order confirmation, and on the Contact Us page. We are reachable by phone, email, and online form during U.S. Eastern business hours.

13. Accurate Product Information

We make commercially reasonable efforts to ensure that product titles, descriptions, images, prices, availability, brand, GTIN/MPN, condition, and shipping information shown on the website match the product you receive. If a listing contains an error, we reserve the right to correct it and to cancel any affected order with a full refund before shipment. Products are sold in new condition from authorized brand sources unless explicitly described otherwise on the product page.

14. Secure Checkout and Billing

All checkout and payment pages are served over HTTPS/TLS, and card data is processed exclusively by our PCI-DSS-compliant payment processor. We do not store full card numbers on our servers.
The amount authorized and billed to your payment method matches the order total displayed and confirmed at checkout (merchandise + shipping + applicable tax). No additional charges are added after checkout without your written approval.
The merchant descriptor that appears on your card statement is "MEDICAL TESTING SOLUTIONS" or "MTS." If you do not recognize a charge, contact us before disputing so we can resolve it directly.
Prices are shown in U.S. Dollars (USD). Currency conversion fees, if any, are determined by your card issuer and are not controlled by us.

15. Promotions and Pricing Adjustments

Discount codes, free-shipping thresholds, and promotional prices are valid only for the period stated and cannot be combined unless explicitly noted. We do not offer retroactive price adjustments on completed orders.

16. Eligibility

By placing an order, you represent that you are at least 18 years old, are purchasing on behalf of a U.S. business or as an individual U.S. resident, and are authorized to use the payment method provided. Certain regulated items (e.g., compressed-gas systems, medical-gas testing services) are sold only to qualified facilities and licensed professionals.
